Agreement to These Terms

These Website Terms of Use govern access to and use of drlyndsey.com and its related webpages (the Website). The Website is owned and operated by Lumi House LLC, an Oregon limited liability company doing business as Lumi Acupuncture. Dr. Lyndsey | Ecology of Care is the public-facing name used on the Website.

By using the Website, you agree to these Terms and our Website Privacy Policy. If you do not agree, please do not use the Website. If you are under the age of legal majority where you live, you may use the Website only with the involvement of a parent or legal guardian.

Website Information Is Educational

The Website, newsletters, Living Library guides, articles, classes, social-media content, and other public resources are offered for general educational and informational purposes. They do not provide individualized medical advice, diagnosis, treatment, or prescribing and are not a substitute for care from a qualified healthcare professional who understands your circumstances.

Using the Website, submitting a contact form, joining the newsletter, or downloading a resource does not create a provider-patient relationship. A clinical relationship begins only when you are accepted into care and complete the applicable patient agreements and informed-consent process. Do not disregard or delay professional medical care because of Website content.

The Website and its forms are not monitored for urgent needs. If you believe you may be experiencing an emergency, call 911 or seek immediate care from an appropriate emergency service.

Licensed Care and Educational Services

Dr. Lyndsey Brozyna, L.Ac., is an Oregon-licensed acupuncturist. Licensed acupuncture and individualized herbal care, including care delivered through telehealth, are provided only when the patient is physically located in Oregon and all applicable professional requirements are met.

The Deep Care Container and other offerings may be available to participants outside Oregon only as general education. For a participant outside Oregon, these offerings do not include the diagnosis or treatment of a medical condition, the practice of acupuncture or another licensed healing art, or individualized prescribing. Availability may be limited by the laws of the participant's location.

Clinical care, educational services, workshops, and other offerings may be governed by separate written agreements, consents, or policies. If those documents conflict with these Website Terms, the separate agreement controls for that service. Disputes concerning patient care are governed by the applicable patient agreement, including any arbitration provision in that agreement, rather than these Website Terms.

Third Party Portals

The Website links to separate portals for scheduling, registration, payment, secure messaging, telehealth, and patient management. PracticeQ is used for Lumi Acupuncture services. Cerbo is used for care provided through SHIFT Functional Medicine. Transactions and information submitted through those portals are governed by the terms, patient agreements, privacy practices, and policies that apply there.

We are not responsible for the availability, security, content, or practices of a third-party website or service that we do not control. A link is provided for convenience and does not alter the terms governing that service.

No Guarantee of Results

Health, educational, and personal outcomes vary. Nothing on the Website promises or guarantees a particular outcome. Any testimonial or description of an individual experience reflects that person's experience and does not establish what another person will experience.

Herbs Supplements and Wellness Information

Public information about herbs, supplements, food, or wellness practices is general education and is not an individualized recommendation. Consult an appropriate healthcare professional before using an herb or supplement, particularly if you are pregnant or nursing, take medication, have a medical condition, or are considering use for a child. Statements about dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Dietary supplements are not intended to diagnose, treat, cure, or prevent disease.

Intellectual Property and Permitted Use

The Website and its original text, guides, graphics, photographs, branding, design elements, audio, video, and other materials are owned by or licensed to Lumi House LLC and are protected by copyright, trademark, and other applicable laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to view the Website and use downloadable Living Library materials for your own personal, non-commercial purposes. You may not reproduce, republish, sell, distribute, modify, publicly display, create derivative works from, or commercially exploit Website content without prior written permission. You may share a link to an original Website page.

Search Engines Automated Tools and Artificial Intelligence

Search engines and AI-powered discovery tools may index, summarize, cite, and link to publicly available Website content when they provide reasonable attribution and a link to the original page. Without our prior written permission, you may not use automated means to bulk scrape, copy, download, build a dataset from, or use substantial Website content to train, fine-tune, or improve an artificial intelligence or machine-learning system. Automated access must not interfere with the Website or circumvent technical restrictions.

To the extent permitted by law, you agree to indemnify Lumi House LLC against third-party claims, losses, or reasonable expenses arising from your unlawful use of the Website, your infringement of another person's rights, or your material violation of these Terms.

Governing Law and Disputes

These Website Terms are governed by Oregon law, without regard to conflict-of-law principles. Before filing a claim concerning the Website, each party agrees to give the other written notice and a reasonable opportunity of at least 30 days to attempt an informal resolution.

A dispute concerning these Website Terms that is not resolved informally must be brought in the state courts located in Deschutes County, Oregon, or in the federal courts having jurisdiction over Deschutes County. This section does not govern a dispute arising from patient care or another service covered by a separate agreement.

Severability and No Waiver

If a provision of these Terms is found unenforceable, it will be modified only to the extent necessary or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

Changes to These Terms

We may update these Terms when the Website, our offerings, or applicable law changes. The effective date at the top identifies the current version. Continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms.
